They can serve as independent and secure vehicles for wealth planning. By placing the ownership of assets into a New Zealand foreign trust, a foreign settlor can ensure protection against unforeseen circumstances including unstable government, asset confiscation, kidnapping, extortion, or potential future creditors. Foreign judgments against a New Zealand foreign trust will only be recognized in limited circumstances.

Forced heirship claims are not recognized, allowing trust settlors to exercise testamentary freedom which is not allowed in their home country.

Nevis became a global leader in the offshore company formation space in the 1990s through the development of an LLC product which combines the benefits of flexibility and outstanding creditor protection.

LLCs are frequently employed as part of a wider trust structure by clients wishing to maintain some level of control and involvement in the management of the trust fund. We are able to offer jurisdictional diversity within client structures by offering the Cook Islands and New Zealand as additional trust jurisdictions.

For clients from jurisdictions unfamiliar with the LLC concept, Nevis business corporations provide an alternative option in a more traditional corporate format.

Nevis multiform foundations are versatile and attractive products for those wishing to combine the asset protection features of a trust with a more streamlined civil law concept that imposes fewer fiduciary responsibilities. The Nevis multiform foundation affords a flexibility not seen in other foundation jurisdictions, and allows foundations to take on the form and share characteristics of other types of entities including trusts, LLCs and partnerships.

LLCs, NBCs and foundations can also be used as private trustee companies for clients wishing to exercise Nevis trustee functions on their own account or through a third party.
